  1. Subject Matter
    1. Bernhard Schussek holds seminars and workshops (hereinafter referred to as "trainings") at his own premises or at the client’s premises.
    2. If so requested by the client, Bernhard Schussek holds trainings specifically tailored to the client’s needs. Details will be agreed on separately.
  2. Registration / Fee
    1. The registration for trainings may only be submitted in writing by e-mail or online. Bernhard Schussek will confirm the registration in writing.
    2. In the case of trainings specifically tailored to the client’s needs, the client’s order is deemed to constitute a registration.
    3. Unless otherwise agreed, the prices for trainings are quoted per participant and do not include VAT. The fee becomes due upon confirmation of the registration by Bernhard Schussek and must be paid by the date of the training or within 14 days of the date of the invoice without any deductions. In case the fee has not been paid in time, Bernhard Schussek may exclude the relevant participant from the event or, as the case may be, cancel the training that has been specifically tailored to the client’s needs.
  3. Cancellation
    1. The client may cancel his/her participation up to 14 calendar days before the start of the training at the latest. If participation is cancelled at a later date, Bernhard Schussek may charge 50% of the participation fee plus VAT; if the event is cancelled one working day before the start of the training or if a participant fails to appear, Bernhard Schussek may charge the full amount of the fee. This does not apply if the participant who cancelled provides a replacement participant.
    2. In the case of trainings specifically tailored to the client’s needs, the following applies: The client may cancel the training up to one month before the start of said training at the latest. If participation is cancelled at a later date, Bernhard Schussek may charge 50% of the agreed fee plus VAT, unless both parties agree to postpone the training. In case of cancellation three days or less before the start of the training, Bernhard Schussek may charge the full amount of the fee, unless both parties agree to postpone the training. Bernhard Schussek will not unreasonably refuse to postpone the training.
    3. Bernhard Schussek reserves the right to cancel the training at any time if the minimum number of participants is not reached or due to organisational or technical reasons, in particular if the trainer has fallen ill. If the client has already paid the fee for the training, either an alternative date will be offered or the amount paid will be reimbursed.
  4. Rights to Documents
    1. Bernhard Schussek reserves all rights to the documents handed out by him during the training. The client is neither entitled to copy or edit those documents nor transmit them to third parties or make them available to third parties in any other way.
  5. Limitation of Liability
    1. Except in the event of gross negligence, Bernhard Schussek's liability is limited to the amount paid for the services provided.
    2. Bernhard Schussek does not assume any responsibility for difficulties or technical problems encountered during the training.
  6. Confidentiality
    1. Bernhard Schussek undertakes to use any knowledge of trade secrets and information marked as confidential in writing that may become known to him in connection with this contractual relationship solely for the purposes of the performance of this contract and any such knowledge is to be kept confidential for an unlimited period of time. The obligation of confidentiality does not apply to data that are already known to Bernhard Schussek at the time the contract is concluded or that were known or become known to him outside the contract.
    2. Bernhard Schussek is not obliged to keep his ideas, concepts, know-how and technologies with regard to programming secret; clause 6.1 remains unaffected.
    3. Bernhard Schussek may include the client’s name and a brief description of the services rendered in a list of references. Any and all other references made to client for advertising purposes will be agreed upon with the client in advance.
  7. Jurisdiction and Applicable Law
    1. Bernhard Schussek designates his principal office address as address for service. The parties will seek to amicably resolve any dispute arising between them as a result of the interpretation or application of the contract. If no amicable agreement can be reached, the dispute will be referred to the court in Vienna, Austria having subject matter jurisdiction. The legal relationship between the parties is governed by Austrian law.
  8. Final Provisions
    1. The General Terms and Conditions for Trainings and any amendments thereto must be made in writing.
